Irina Zamyatin successfully wins summary judgment and dismissal of an action pertaining to podiatric surgery. Plaintiff alleged that the defendant podiatrist negligently performed hammertoe repair surgery which caused permanent nerve damage and need for nerve resection surgery. FKB was able to prove that the surgery was properly performed and that the defendant’s treatment had no nexus to the alleged injuries. Further, FKB argued that the plaintiff’s expert’s opinions were conclusory and failed to adequately respond to the defendant’s expert’s opinions. The New York County Supreme Court agreed with FKB’s position. The Court dismissed the claims for medical malpractice, informed consent, and loss of consortium.
