FKB’s Tracy S. Katz obtained dismissal on behalf of an oncologist and oncology practice in an alleged medical malpractice case.

In this medical malpractice case, plaintiff alleged that FKB’s clients, an oncologist and his oncological practice, negligently treated the patient with chemotherapy for breast cancer. Plaintiff alleged that FKB’s clients’ negligent oncological treatment resulted in the patient suffering four small bowel obstructions, necessitating surgery and ultimately causing her death. Plaintiff also claimed FKB’s clients failed to diagnose the small bowel obstructions and timely refer the patient for the appropriate treatment. The defense made numerous pre-trial successful motions resulting in the dismissal of the case.
