FKB’s John Gizunterman and Christopher Fox obtain dismissal of a Kings County action alleging medical malpractice. In this action FKB represented a prominent New York pulmonologist against allegations of failure to diagnose pneumonia. In reaching its decision the Court accepted FKB’s argument that plaintiff’s presentation was consistent with her chronic conditions and did not warrant radiologic testing.
