FKB’s Aaron M. Barham and Lisa Burns obtained a pre-answer dismissal of a complaint on behalf of a real estate and property management firm dedicated to community development through affordable housing programs.

In this case, the litigious plaintiff had previously brought substantially similar lawsuits alleging unfair treatment and discrimination by FKB’s client and seeking both injunctive relief and monetary damages.   In their motion to dismiss, FKB successfully argued that the Plaintiff’s claims were barred by res judicata and collateral estoppel, and that Plaintiff’s litigation was without merit and otherwise failed to state a cognizable claim upon which relief could be granted.
