On Thursday, October 10, 2013, FKB’s Andrew Jones and Izabell Lemkhen, spoke at the 2013 Annual Meeting and CLE/CEU Presentation of the Professional Liability Defense Federation. Andrew and Izabell, along with Erin Higgins, Esq. and Timothy Gephart, CPCU, lead an interactive discussion regarding common ethical and practice issues raised by representation. Specifically, Andrew and Izabell spoke about the common interest doctrine and whether communications between an attorney and his/her malpractice carrier are privileged from disclosure in a subsequent malpractice action. Andrew and Izabell’s presentation also included written materials more thoroughly discussing disclosure of insured-insurer communications in various jurisdictions (attached article).

The Professional Liability Defense Federation is an association of malpractice defense professionals. This year’s meeting focused on discussions of developments in legal, medical, construction design, real estate agent/broker, dental, insurance agent/broker, and miscellaneous professional liability claims.
